Welcome to EquineProFinder. By accessing or using our website, directory, business tools, forms, search features, listings, content, or related services, you agree to these Terms of Service.

Acceptance of Terms

These Terms form a binding agreement between you and EquineProFinder. If you use the platform on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the platform.

User Eligibility

EquineProFinder is intended for users who are at least 18 years old and legally able to enter into contracts. By using the platform, you represent that you meet these requirements and that your use complies with all applicable laws.

Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for promptly notifying us of any unauthorized use, security incident, or suspected compromise. We may suspend or terminate accounts that present a security, legal, or operational risk.

Listings, User Content, and Platform Role

You are solely responsible for the accuracy, legality, and completeness of any listing, profile, image, review response, message, or other content you submit. You represent that you have all rights necessary to submit that content and that it does not infringe the rights of others.

EquineProFinder is a discovery and marketing platform. We do not endorse, guarantee, insure, or supervise any listed business, provider, or user. Any relationship, transaction, or dispute between users and listed businesses is solely between those parties.

Subscriptions, Billing, and Refunds

Paid plans renew according to the billing cycle shown at checkout unless cancelled in accordance with your plan terms. You authorize recurring charges for any subscription you purchase. Fees are generally non-refundable except where required by law or where EquineProFinder expressly agrees otherwise in writing.

We may change pricing, plan features, or billing practices prospectively. Continued use of a paid plan after notice of a change constitutes acceptance of the updated pricing or plan terms.

Prohibited Conduct

You may not use the platform in any unlawful, abusive, deceptive, or commercially harmful way. This includes attempting to interfere with the platform, impersonating another person, submitting false information, reverse engineering protected portions of the service, or bypassing any security, rate-limit, access-control, or technical restriction.

You may not use any robot, spider, scraper, crawler, browser automation tool, AI agent, model training pipeline, script, or other automated means to access, monitor, copy, collect, index, export, republish, or exploit any portion of the platform, including listing data, contact information, images, reviews, metadata, page structure, or search results, without our prior written consent. You also may not use the platform or its content to build, train, enrich, or operate a competing database, lead list, directory, search index, or machine learning dataset.

Any unauthorized scraping, harvesting, bulk extraction, or automated querying is a material breach of these Terms and may also violate applicable computer access, fraud, copyright, trespass, unfair competition, or similar laws.

Remedies for Unauthorized Scraping

You acknowledge that unauthorized scraping or automated data extraction can cause harm that is difficult to measure precisely, including damage to the value of our curated data, infrastructure burden, investigation costs, and loss of business opportunities. To the fullest extent permitted by Kentucky law, if you engage in prohibited scraping or automated harvesting, EquineProFinder may elect liquidated damages instead of attempting to prove direct damages for that violation.

The liquidated damages amount will be the greater of: (a) $1,000 for each day on which the prohibited conduct occurs, or (b) $10 for each listing, profile, or record accessed, copied, exported, used, or republished in violation of these Terms, with a cap of $25,000 for any single incident. The parties agree this amount is intended as a reasonable pre-estimate of likely harm and not as a penalty. This liquidated damages provision does not limit our right to seek injunctive or other equitable relief to stop the violation.

Intellectual Property

The platform, including its software, design, compilation, branding, layout, text, graphics, and other non-user content, is owned by EquineProFinder or its licensors and is protected by intellectual property laws. Except for the limited right to use the platform in accordance with these Terms, no rights are granted to you.

Disclaimers

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, EquineProFinder disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

Limitation of Liability

To the fullest extent permitted by law, EquineProFinder and its affiliates, owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to the platform or these Terms.

To the fullest extent permitted by law, EquineProFinder's aggregate liability for any claim arising out of or related to the platform or these Terms will not exceed the greater of: (a) the amount you paid to EquineProFinder in the 12 months before the event giving rise to the claim, or (b) $100.

Indemnification

You agree to defend, indemnify, and hold harmless EquineProFinder and its affiliates, owners, officers, employees, contractors, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to your content, your use of the platform, your violation of these Terms, or your violation of any law or third-party right.

Termination

We may suspend, restrict, or terminate access to the platform at any time, with or without notice, if we believe you have violated these Terms, created risk for the platform or other users, or if termination is otherwise necessary for legal, security, or operational reasons.

Kentucky Governing Law and Venue

These Terms, your use of the platform, and any dispute, claim, or controversy arising out of or relating to EquineProFinder will be governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. You agree that any action or proceeding arising out of or relating to these Terms or the platform must be brought exclusively in the state courts of Kentucky or the federal courts sitting in Kentucky, and you consent to the personal jurisdiction and venue of those courts.

Electronic Communications and Contracting

You agree that notices, disclosures, records, and other communications may be provided electronically and that your electronic actions and submissions are intended to have the same force and effect as a handwritten signature, to the fullest extent permitted by applicable Kentucky law.

Changes to Terms

We may update these Terms from time to time by posting the revised version on this page. Changes are effective on the posted "Last Updated" date unless a later date is stated. Your continued use of the platform after the updated Terms become effective constitutes acceptance of the revised Terms.
